To prove this offense, the State must establish each of the following elements: Driver going slower than normal traffic flow; Drive in right-hand lane; Or as near to right curb/edge as practical.

Worked example 1

Texas's 'Slow Vehicle' law (§545.363) requires a driver moving slower than the normal speed of traffic to:

  1. Drive in the center lane
  2. Drive in the right-hand lane available for traffic, or as close as practical to the right curb or edge of the roadway Correct
  3. Stop and wait for traffic to pass
  4. Drive on the shoulder
Why: On a roadway with multiple lanes in the same direction, slower-moving vehicles must keep right except when overtaking, preparing to turn left, or as otherwise directed.
