Equipment is covered under ch. 548 and tested on the TCOLE peace officer licensing exam.

To prove this offense, the State must establish each of the following elements: Non-commercial passenger vehicles: no safety inspection required after 1/1/2025; Emissions: still required in 17 covered counties; Commercial vehicles: full inspection required; Violations: Class C misdemeanor.

Worked example 1

Operating a motor vehicle without a current/valid Texas inspection sticker (where required) is generally:

  1. A Class B misdemeanor
  2. A Class C misdemeanor under Tex. Transp. Code §548 (state inspection); note: passenger vehicles in Texas no longer require safety inspection (eff. Jan 1, 2025) — but emissions inspection and commercial inspection still apply in covered counties Correct

Why: Effective January 1, 2025, Texas eliminated annual safety inspections for non-commercial vehicles. Emissions inspections (in 17 covered counties) and commercial vehicle inspections remain. Non-compliance is generally a Class C misdemeanor.
