Robbery

Elements

  • A person
  • In the course of committing theft (as defined in Chapter 31)
  • With intent to obtain or maintain control of the property
  • Intentionally, knowingly, or recklessly causes bodily injury to another; OR
  • Intentionally or knowingly threatens or places another in fear of imminent bodily injury or death

Penalty

Second-degree felony — 2 to 20 years TDCJ + up to $10,000 fine (§12.33).

Enhancements

Becomes Aggravated Robbery under §29.03 if the actor: causes serious bodily injury; uses or exhibits a deadly weapon; OR causes bodily injury or threatens/places fear of imminent injury or death in a person 65 or older or a disabled individual.
