Money Laundering
Elements
- Knowingly
- Acquires or maintains an interest in, conceals, possesses, transfers, or transports the proceeds of criminal activity; OR
- Conducts, supervises, or facilitates a transaction involving the proceeds of criminal activity; OR
- Invests, expends, receives, or offers to invest, expend, or receive the proceeds of criminal activity or funds the actor believes are the proceeds of criminal activity; OR
- Finances or invests or intends to finance or invest funds the actor believes are intended to further the commission of criminal activity
Penalty
Value-based ladder under §34.02(e): $2,500 to $30,000 — state jail felony (180 days to 2 years + up to $10,000 fine, §12.35); $30,000 to $150,000 — 3rd degree felony (2 to 10 years + up to $10,000 fine, §12.34); $150,000 to $300,000 — 2nd degree felony (2 to 20 years + up to $10,000 fine, §12.33); $300,000 or more — 1st degree felony (5 to 99 years or life + up to $10,000 fine, §12.32).
Enhancements
Standard habitual offender enhancements under §12.42. Civil forfeiture under Tex. Code Crim. Proc. ch. 59 typically follows. Federal money laundering charges under 18 U.S.C. §§1956–1957 may apply concurrently.
