Penalty
Second-degree felony — 2 to 20 years TDCJ + up to $10,000 fine (§12.33).
Enhancements
If the conduct involved operation of a motor vehicle/aircraft/watercraft while intoxicated, charge as Intoxication Manslaughter under §49.08 (also 2nd degree, but with additional consequences). If the death is of a peace officer in line of duty under certain circumstances, may bump to capital murder under §19.03.
