Aggravated Robbery
Elements
- A person
- Commits robbery as defined in §29.02; AND
- Causes serious bodily injury to another; OR uses or exhibits a deadly weapon; OR causes bodily injury, threatens, or places in fear of imminent bodily injury or death a person 65 years of age or older or a disabled individual
Penalty
First-degree felony — 5 to 99 years or life TDCJ + up to $10,000 fine (§12.32).
Enhancements
Use of a deadly weapon is itself a 3g offense affecting parole eligibility (must serve at least half, or 30 years, before parole eligibility — Tex. Code Crim. Proc. art. 42A.054). Standard §12.42 habitual enhancements apply.
