Aggravated Assault

Elements

  • A person
  • Commits assault as defined in §22.01; AND
  • Causes serious bodily injury to another (including the person's spouse); OR uses or exhibits a deadly weapon during the commission of the assault

Penalty

Second-degree felony — 2 to 20 years TDCJ + up to $10,000 fine (§12.33).

Enhancements

First-degree felony if: committed against a public servant on duty (or in retaliation); committed by a public servant acting under color of office; committed against a person reported to be a crime witness or against a security officer on duty; committed against a member of the actor's household and the actor used a deadly weapon and caused serious bodily injury; or committed by drive-by shooting causing serious bodily injury to a member of a household. — 5 to 99 years or life + up to $10,000 fine (§12.32).
